Socratic Club Special - Burns Night - 25th January 2026

Burns Night is both a celebration of cultural tradition and an opportunity for reflection on history, identity and values. Our Burns Night Special Socratic Club session combined discussion of Robert Burns and the customs associated with the evening with a legal and debating focus on Scotland’s distinctive justice system.
The session explored key differences between the Scottish legal system and that of England and Wales, highlighting Scotland’s mixed legal heritage and its approach to criminal evidence. Students examined the requirement for corroboration under the Scottish “two-item rule” and considered whether this standard offers stronger safeguards for the accused or presents challenges for prosecution.
We also discussed Scotland’s recent abolition of the “not proven” verdict, effective from January 2026. This led to a thoughtful debate on whether the reform increases clarity and fairness or removes an important element of legal nuance.
Alongside the legal discussion, members reflected on Burns Night traditions, including ceremony, language, and dress and how cultural customs continue to shape national identity. This was an engaging session with excellent contributions from the group.
There was much more to explore, and the discussion opened the door to further questions and debate. We very much look forward to continuing these conversations in our upcoming sessions.
